In court filings this week, United States Department of Justice attorneys conclude the city of Alpharetta may have discriminated against a mosque by denying its plans to expand.
WSBTV The Islamic Center of North Fulton wants to tear down its existing facility to build a much larger one on its Rucker Road property.
In 2010, the city voted down the center’s plan, in part, because of an agreement the center made with neighbors never to expand beyond its current facility. In January, U.S. District Judge Owen Forrester ruled he found no such agreement ever existed but still sided with the city, ruling the mosque didn’t show the denial put a substantial burden on its members.

On Tuesday, DOJ attorneys filed a “friend of the court” brief, calling into question Forrester’s decision.
“The district court applied an erroneous legal standard in granting the city’s summary judgment motion,” the brief said. “The court should have asked instead whether the denial of the permit … actually and substantially inhibits the center’s religious exercise, rather than merely inconveniencing it.”
Attorneys also wrote that the evidence suggests the city discriminated against the mosque. “The fact that the city’s own community development staff found that the proposed mosque will have no greater effect on the surrounding area than many churches located nearby … is sufficient to raise a reasonable inference of discrimination,” the brief said.
Dillard told Petchenik the department’s intervention is “significant,” because it waited until the case was on appeal to render an opinion about the situation. “They’re saying in their opinion, the religious land use law was violated, and the lower court didn’t follow existing case law,” he said.
DOJ attorneys have asked the 11th Circuit Court of Appeals to send the case back to district court for reconsideration.
Petchenik contacted the city of Alpharetta for comment, but its attorney didn’t respond.
Longtime neighbor William Jordan scoffed at the notion the city discriminated against the mosque. Jordan said neighbors were concerned about the architecture of the proposed building and any additional traffic that could come with the expansion. “If they just came in and redid that building, we’d have no complaints at all,” he said.

Unfortunately the way the law is written if you say it is the religion you will lose. You have to prep the battlefield. If their are no mega churches in your area write the general plan to forbid any thing of a nature that sticks out. If there is a defin ing archtexture to your community write into your general plan. Write ordinances to forbid blocking streets and sidewalks with staionary pray ins. Define the “call to prayer” interms of a generic noise element to the general plan. And finally remember most land use proposals can be killed with an effective local protest. In California new land uses are subjects of letters sent to all property owners within 1,000 feet. Make sure YOUR people are on the planning commision and the human rights commission. CAIR has been doing this for at least 10 years.

I live about 10 miles from this mosque and drive by it often. Currently it’s a converted home and the picture above is some artist’s rendering of the proposed structure, not the current one. But this is in the middle of a residential area, and supersizing this mosque for a congregation that is not that large would greatly foul up traffic. Of course reality matters not to the Islamophiles at the BHO DOJ.

I don’t know the membership size–this mosque, like many, is not exactly transparent with info–but based on the number of cars I see there on Friday afternoon for khutba, I’d estimate at most a few hundred. So it would seem that a much larger structure, as they proposed, would indicate more of a desire to mark territory than a real need. And of course once can’t ignore the possibility that this is a calculated strategy: ask to build bigger in an area where it’s likely to be rejected, then play the victim card when that comes to pass.
I live just down the road in Roswell and used to drive by that dump every day on the way to work. I recently discovered that we have ticking Islamic zoning bomb in Roswell on Old Mountain Park Road which bears an uncanny resemblance to the Rucker road IC. Muslims have a strategy of finding ramshackle ’50′s-era ranch houses on 1-2 acre lots which are not in subdivisions. The lots are usually not too far from a major traffic artery and in locations where zoning is in flux from residential to commercial. This is a fairly common practice for.many churches, but as Lord Kabigon says above, special care must be taken by city leaders to beef up zoning and noise ordinances, height restrictions etc., preferably before the first Islamic Center pops up, and certainly before it metastasizes.
I hope that after the Andrew Wordes tragedy that Mayor Jere Woods will.be more proactive on zoning issues, but I get the impression that a tacky, minaret-festooned bunker is in Roswell’s near future.

Alpharetta has a mixed record on Muslim encroachment. On the plus side, the city denied the Amana charter school(taxpayer-funded) its request to move Gehenna campus into an office park warehouse. On the minus side, the city got burned on a 19 million dollar bond it floated to finance the construction of another taxpayer-funded charter school-this one being run by Gulenists. Fulton County wisely denied charter recertification, but the bond is in default now, and 6 million dollars are unaccounted for.
I hope Alpharetta stands firm and holds off Holder’s jihad until we get a non-dhimmi DOJ again, they’ll probably cave like nearby Lilburn did.
The US Department of Justice can pursue these matters as they see fit, and inevitably, citizens, recognizing the Department of Justice for the treasonous collection of islamic collaborators it is, will naturally follow several courses of action.
1) The people will realize the utter futility in following along peaceful, conventional paths as a redress to the hostile advances of muslims and their multiplicity of mosques and they will resort to avenues of greater efficacy. I would gloss that to say “most” and “potential,” because 1) there are a few sects of Islam (like the Isma’ilis, a Shi`i sect different from the Iranian Twelvers) that are truly moderate, and 2) many Muslims believe in the same goals as the terrorists–Islamic rule here and everywhere–but are willing to accomplish that by conversion, demography (having babies) and playing the victim card rather than planting IEDs and underwear bombs. But either way is a threat.
