New York Federal Court Strikes Down ‘Demeaning’ Speech Restriction; MTA Must Run Advertisement Opposing Jihad and Supporting Israel. The controversial AFDI Ad (below) is not only protected speech, it is core political speech. The Ad expresses AFDI’s pro-Israel perspective on the Israeli/Palestinian conflict in the Middle East, and calls for a pro-Israel U.S. foreign policy with regard to that conflict.

New York, New York (July 20, 2012) — Earlier today, Federal Judge Paul A. Engelmayer, sitting in the U.S. District Court for the Southern District of New York, ruled that the New York Metropolitan Transportation Authority’s (MTA) restriction on “demeaning” speech was unconstitutional.  The MTA had refused to run an anti-jihad advertisement that, according to the MTA, referred to Israel’s enemies as savages who engaged in jihad.  The MTA flagged the advertisement that was set to run on the exterior of its buses, claiming that it violated the MTA’s policy against displaying “images or information that demean an individual or group of individuals on account of race, color, religion, national origin, ancestry, gender, age,disability or sexual orientation.”

The court struck down the MTA’s speech restriction as a violation of the First Amendment because the MTA, as a governmental agency, was permitting politically controversial speech, even demeaning speech, but not speech that demeaned specific groups or individuals that fit within the MTA’s protected classes (in this case, Muslims embracing savage jihad). READ MORE

    Excellent we need judges over here like this man. I shall keep this information. Gillard wants to censor our Internet and is striving to get legislation approved that demands we the people must give the government access to all our passwords. If this legislation is passed we are sent to gaol. Which means that since I shall refuse to obey this law that is where I will end up. I shall be investigating this further.

  4. According to the NY Slimes article Judge Engelmayer said in his decision:

    “As long as it demeaned a group not in the prohibited list”. What “prohibited list”? Who determines what is on the “prohibited list”? What kind of f’ing doubletalk is this? I’ll bet the muslimo-nazis are going to be desperate to get every word associated w/pisslam on this “prohibited list”.

  5. Well Ms. Geller’s correct to call them exactly what they are > SAVAGES!!! She’s been fighting this for awhile and it’s good to see this victory. Which should have Never been an issue in the first place – but you know those “savages” (CAIR) just have to whine and cry and sue!

    • GM, I was wondering what happened to you. You couldn’t get into the site at all? Or just into comments?

      • Hi Bonni. Several times recently I couldn’t get to BNI AT ALL -and it seemed to be something specific to the site, as I tried several times, and it would just “time out” -yet I was able to instantly click to other sites.

        … But I didn’t have any problem today or yesterday.

        • GM, you may have been trying when the server was down a few times. It goes down when the traffic load is too heavy or from a constant barrage of hackers trying to take it down. Drop me an email if you have trouble and I’ll let you know if it’s your computer or the site. Some ISP’s are trying block access to BNI – what they like to call a “Hate Site.” But there are always ways around it, or so I hear.

        • It’s getting cleared up as we speak, most problems will be fixed shortly but others will pop up once in a while. This is the Gov. Trying to take over all sites it doesn’t like and because BNI has a strong site, so they are going after personal computers and messing with the IPO’S.

  8. I heard in the Brussels conference. That we won freedom of speech. which ruled out the Cairo declaration.If this is true,Dose this now mean we can’t be prosecuted for speaking out and telling the truth?
    Can any body let me know where we stand on this matter?

  9. What galls me the most is that this is the city where we used to have 2 110 story towers, did the MTA forget who took those 2 buildings down that beautiful Tuesday morning? It was’nt Evangelicals or Hasids!
